2008 Great Sacramento Duck Race Official Rules and Regulations
1. The 2008 Great Sacramento Duck Race sweepstakes or contest ("Duck Race") is presented by Special Olympics Northern California, Inc. ("SONC"), a California nonprofit public benefit corporation that is a charitable organization under Section 501(c)(3) of the Internal Revenue Code.
2. The Duck Race will take place on September 27, 2008, on the Sacramento River near Sacramento, California, at a location to be determined by SONC in its discretion. A maximum number of 25,000 rubber ducks will be entered in the Duck Race.
3. NO PURCHASE OR DONATION IS REQUIRED TO ENTER THE DUCK RACE.
The suggested donation for the adoption of each rubber duck to be entered in the Duck Race is $5.00 per duck. Net proceeds received from the Duck Race will benefit SONC and its charitable purposes. SONC makes no representations as to the state or federal tax deductibility of Duck Race donations. Participation in the Duck Race is available only to those individuals who are at least 18 years of age as of September 27, 2008. However, the parent or guardian of a minor may participate on behalf of his or her child or ward, in which case both names may be entered on the duck adoption or entry form(s).
4. A number will be attached to each duck entered in the Duck Race relating to the number on the completed adoption paper or entry form for each such duck. The individuals listed on the adoption papers or entry forms corresponding to the first ten (10) ducks in order of finish will be awarded prizes. The odds of winning a prize in the Duck Race are contingent on the number of valid entries received, but the chances will be at least 1 in 25,000 for the first prize, 1 in 24,999 for the second prize, 1 in 24,998 for the third prize, 1 in 24,997 for the fourth prize, 1 in 24,996 for the fifth prize, 1 in 24,995 for the sixth prize, 1 in 24,994 for the seventh prize, 1 in 24,993 for the eighth prize, 1 in 24,992 for the ninth prize and 1 in 24,991 for the tenth prize. SONC will determine, in its sole discretion, the order of finish in the Duck Race and will assign, in its sole discretion, the associated prizes to the winners. Duck Race winners need not be present to win. Each winner will be notified in writing via US mail during the week following the Duck Race, and must personally pick up or pay for the delivery (including reasonable postage and handling fees) of his or her assigned prize from the office of SONC (provided in Rule 9 below) by December 31, 2008. Any winner who does not claim his or her prize by that date will forfeit the prize. Positive photo identification (driver's license, state ID, or passport) will be required to claim any prize(s). Any winner claiming a prize must be at least 18 years of age.
5. The entry portion of each adoption paper for each duck to be entered in the Duck Race must be completed in its entirety and, along with any associated donation(s): a) mailed to the Northeast Regional office of SONC located at the address provided in Rule 9 below; or b) delivered to an authorized representative of SONC at the office of SONC or at any other location as determined by SONC. No donation(s) is required to enter the Duck Race and/or adopt any duck(s). Donations may be made in cash (US Dollars), by personal checks made out to SONC, or through a credit card transaction. Each completed adoption/entry, along with any associated donation, must be received by SONC staff before 5:00 p.m. on Friday, September 26, 2008, to be eligible to enter the Duck Race and win any prizes. Notwithstanding the foregoing, if any ducks remain available after that time for entry in the Duck Race, SONC may, in its sole discretion, make more duck adoptions/entries available up to and including the day of the Duck Race. Entries received in this manner after 5:00 p.m. on September 26, 2008, will be subject to the availability of remaining ducks. In the event that the number of these last-minute entries exceeds the remaining number of ducks available, the last-minute entrants will not be eligible to win any prizes. Entrants assume the risk of non-delivery of any entries to SONC as required under these rules. SONC is not responsible for any entries or donations lost in the mail.
6. Notwithstanding Rule 5 above, submission of duck adoptions/entries for the Duck Race, and any associated donations to SONC, may also be accomplished through the Internet at the following URL: www.sacramentoduckrace.com. Such entries are also subject to these Rules and may be accepted until 10:00 p.m. on Friday, September 26, 2008.
7. All ducks entered in the Duck Race are the property of SONC and will remain the property of SONC.
8. The combined retail value of all prizes in the Duck Race will be up to $10,000.00, as determined by SONC in its sole discretion. SONC reserves the right to substitute prizes of a comparable value up to the day of the Duck Race.
9. A list of the Duck Race prizes and prizewinners can be obtained from SONC after September 30, 2008, by sending a written request with a self-addressed, stamped envelope to: 2008 Great Sacramento Duck Race, c/o Special Olympics Northern California, Northeast Region, 3841 North Freeway Boulevard, #280, Sacramento, CA 95834.
10. No cash-equivalent prizes or exchanges will be provided in lieu of the designated prizes determined by SONC. Payment of any associated state or federal taxes and fees is the sole responsibility of each prizewinner.
11. By their participation, each Duck Race entrant agrees to abide by these Rules, and also agrees to assume all liability for any injury, harm, or damage that may arise in connection with that entrant's participation in the Duck Race, or by the use or redemption of any prize by such entrant. Each entrant further agrees to indemnify, release, hold harmless and defend SONC and Special Olympics, Inc., including their officers, directors, volunteers, employees, and agents, as well as any other entities or individuals involved in hosting the Duck Race, including any owner or lessor of the property where any Duck Race activity takes place, from and against any and all liability arising from the entrant's participation in the Duck Race or from the entrant's use or redemption of any Duck Race prize.
12. By entering the Duck Race, each entrant consents, without any payment or compensation, to the use by SONC or any other person or entity of the entrant's name, voice and/or likeness for advertising or promotional purposes, including through video, film, television, radio, newspaper, magazine, or any other media, in any form or format, including in or through the SONC and Duck Race Websites.
13. The Duck Race is subject to all applicable federal, state and local laws and restrictions. SONC is not responsible or liable for telephone, network, ISP, electronic, computer or other communication problems or failures of any kind, or for entries that are misdirected, incomplete, unclear, delayed in transmission, lost, late, damaged, unreadable, or ineligible.
14. Any individual aged 18 or older may personally request to adopt and enter a duck(s) in the Duck Race between the hours of 9:00 am and 5:00 p.m., Monday through Friday, at the address set forth in Rule 9 above, pursuant to the deadlines provided in Rule 5.
15. Employees of SONC and any participating sponsors in the Duck Race, including their immediate family members, are not eligible to enter the Duck Race.
